Carnet Valet Privacy Policy

applies to the boomerang carnets® (”websites and services and describes how User Information is collected, used, disclosed, and protected by boomerang carnets®. Each User agrees to this Policy by using or continuing to use any of boomerang carnets® use of the boomerang carnets® Service is subject to the boomerang carnets® Capitalized Terms used in this Policy, but not defined, shall have the meanings given in the User Agreement. To the extent of any inconsistency between this Policy and the User Agreement, the terms of the User Agreement shall control.

Changes to This Policy

Boomerang carnets® may change this Policy at any time. Boomerang carnets® mail address that User has configured in boomerang carnets®, or through a posting on the boomerang carnets® website.

Information Collected

Boomerang carnets® interaction with the boomerang carnets® location, in various ways whenever the User uses any of boomerang carnets® s Service. Boomerang carnets® may supplement this information with information from other companies. Boomerang carnets® collects.

Registration and Profile Information. Automatically Collected Information. Boomerang carnets® automatically receives certain types of information when the User interacts with ss IP address, access times, service provider, its browser type and language, and referring website addresses. Boomerang carnets® may also collect information about the type of operating system the User uses, its account activity, and files and pages accessed or used by such User.

Use of User Information

Boomerang carnet®s uses User Information to provide the Service to User and integrate with other add-on services that complement the boomerang carnets® Service. Boomerang carnets® will use the User Information to provide all services and products offered through the boomerang carnets® Service, and fulfill all its obligations under the User Agreement. Boomerang carnets® User Information:

to request feedback and to enable boomerang carnets® to develop, customize and improve the Service and its publications, products and services;

to conduct marketing analysis, to send the User surveys or newsletters, to contact such User about services, products, activities, special events or offers from boomerang carnets® or its partners and for other marketing, informational, product development and promotional purposes;

sales services; to anticipate and resolve problems with s Service; to respond to customer support inquiries, for assistance with s product and Service development; and to inform the User of updates to products and Services from boomerang carnets® needs;

for other purposes about which boomerang carnets® notify the User.
• for other products and services that are different from the Service being used by the User.

Sharing of Information

Boomerang carnets®' User Information or any data that the User gives boomerang carnets® in connection with the boomerang carnets® Service to any third party as outlined in this Policy or in the Agreement. Boomerang carnets® may also disclose information to a third party to (a) comply with laws or respond to lawful requests and legal process; (b) to protect boomerang carnets®, agents, customers, and others including to enforce its agreements, policies and terms of use; or (c) in the good faith belief that disclosure is needed to respond to an emergency, or protect the personal safety of any person.

Boomerang carnets® may provide the User with opportunities to connect with third party services. If the User chooses to use any such third party services, Boomerang carnets® use of such services is not governed by s User Agreement or this Policy. Boomerang carnets® information and documents. The User is responsible for reviewing the terms and the privacy policies of those third parties before using their services.

Network and Information Security

Boomerang carnets® takes steps it deems reasonable to protect information it collects from the User to prevent loss, misuse and unauthorized access, disclosure, alteration, and destruction. In addition, highly confidential User Information such as credit card numbers and passwords that it requests from the User is protected with such encryption as reasonably determined appropriate by boomerang carnets® s account information and access to s service may, at s options, be accessible only through the use of an individual user ID and password. To protect the confidentiality of User Information, the User must keep its password confidential and not disclose it to any other person. The User must advise boomerang carnets® immediately if it believes its password has been compromised or misused. THE LIMITATIONS ON LIABILITY PROVIDED IN THE USER AGREEMENT ALSO GOVERN THIS POLICY.

Boomerang carnets® may share User Information or information that pertains to User, with appropriate third parties if (1) the User: (a) during registration had intentionally provided wrongful or erroneous information; (b) engaged in any act that is harmful or may be harmful to boomerang carnets®, or any third party, including but not limited to other users, s suppliers or s partners; (c) used or attempted to use the Service or any boomerang carnets® use of the website or the boomerang carnets® Service allows, facilitates, assists or encourages the commission of such acts; (d) violated the terms of this policy or the Agreement; (2) the sharing of information is required to satisfy an order or decree prescribed by a judicial or administrative authority; or (3) the sharing of information is required for the purpose of detecting, preventing or otherwise addressing technical issues, security breaches, or instances of suspected wrong doings of fraudulent nature.

Choice/Opt-Out

Boomerang carnets® may send the User communications or data regarding the boomerang carnets® use of the boomerang carnets® Service, including any notices concerning violations of use, (ii) updates, and (iii) promotional information and materials regarding sort of receiving promotional emails from boomerang carnets® out of receiving promotional emails and other promotional communications from boomerang carnets® current account and services.

General Provisions.

This Agreement (i) shall be governed by Illinois law; (ii) contains the entire understanding between User and boomerang carnets® regarding the subject of this Agreement, and supersedes all previous oral or written agreements or understandings between User and boomerang carnets® permitted successors and assigns; (iv) shall be subject to legal proceedings exclusively in Cook County, Illinois (except that actions to enforce a judgment or for specific performance may be located elsewhere as necessary); (v) shall not be waived except in writing signed by boomerang carnets® (which waiver shall only relate to the specified right or obligation); (vii) shall require that written notices be made to boomerang carnets®; (viii) shall not be subject by a trial by jury, WHICH TRIAL BY JURY IS HEREBY WAIVED BY THE PARTIES; (ix) shall not be deemed to establish a partnership, agency or joint venture among the parties; (x) shall not be assignable by User (by operation of law or otherwise) without the prior written consent of boomerang carnets® (a change of control involving User shall constitute an assignment requiring consent); (xi) shall not be affected by the invalidity or un-enforceability of any provision, which such provision shall be deemed severable and not affect the remaining valid and enforceable provisions of this Agreement; and (xii User shall pay s fees), to enforce any provision of this Agreement, including any failure by User under this Agreement to pay any amounts due, take any action required, or return any property to boomerang carnets®.
